Terms of Service

These terms govern use of Beyond Care, a hospital and clinic management platform provided by Beyond Care Technologies Pvt Ltd ("we", "us"). By creating an organisation or staff account, you agree to these terms on behalf of yourself and, if applicable, the organisation you represent.
Acceptance of terms
By signing up for, accessing, or using Beyond Care, you confirm that you have the authority to bind the hospital, clinic, or organisation you represent to these terms. If you do not agree, do not use the Service.
The Service
Beyond Care is a multi-tenant hospital/clinic management platform. Organisations subscribe to a plan and turn on the modules they need — such as appointments, consultations, pharmacy, lab, in-patient management, billing, and analytics — with a core patient/administration module included on every plan. Feature availability depends on the plan and modules an organisation has active.
Accounts & responsibility for your staff
The person or organisation that creates an account is responsible for all activity under it, including staff accounts they create (doctors, receptionists, nurses, pharmacists, lab technicians, and other roles). Organisations are responsible for:
- Assigning roles and access appropriately to their own staff.
- Keeping login credentials confidential and promptly deactivating staff who leave.
- Ensuring the accuracy of data entered into the Service, including patient records.
- Obtaining any consents from patients required by applicable law before entering their data.
Your data & our role as processor
As between an organisation and us, the organisation owns the patient and operational data it enters into the Service. We process that data to provide the Service, as described in our Privacy Policy, and do not use it for purposes outside providing and supporting the Service.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or to store or transmit data you do not have the right to hold.
- Attempt to access another organisation's data, bypass access controls, or probe/test the Service's security without our written permission.
- Reverse-engineer, resell, or white-label the Service outside of an agreed Enterprise arrangement.
- Upload malicious code or content that could disrupt the Service for other organisations.
Subscriptions, billing & the Enterprise tier
Subscription plans are billed as described on our pricing page at the rates in effect at the time of billing. We may change plan pricing prospectively, with notice to active subscribers before it applies to their next billing cycle.
The Enterprise offering (a one-time-licensed, dedicated, white-labelled deployment) is governed by a separate agreement negotiated directly with us, entered into after contacting us — these general terms apply only where that agreement doesn't say otherwise.
Availability & support
We aim to keep the Service reliably available and will make reasonable efforts to fix faults promptly, but we do not currently commit to a formal uptime service-level agreement outside of a specific Enterprise agreement that states one. Support is available at support@beyondcarehms.in.
Intellectual property
We own all rights in the Beyond Care software, branding, and website. Subscribing to the Service grants your organisation a limited, non-exclusive, non-transferable right to use it for your own internal hospital/clinic operations for as long as your subscription is active — it does not transfer ownership of the software to you.
Suspension & termination
You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate an account that breaches these terms, fails to pay for an active subscription, or poses a security risk to the Service or other organisations, with notice where practical.
Disclaimers
The Service is provided "as is". Beyond Care is administrative and clinical workflow software — it does not provide medical advice, and clinical decisions remain the responsibility of the treating doctors and the hospital/clinic using it.
Limitation of liability
To the extent permitted by law, our liability for any claim arising from your use of the Service is limited to the fees your organisation paid us for the Service in the twelve months preceding the claim. We are not liable for indirect or consequential losses.
Governing law
These terms are governed by the laws of India, and disputes will be subject to the exclusive jurisdiction of the courts at Surat, Gujarat.
Changes to these terms
We may update these terms as the Service evolves. We will update the "Last updated" date above when we do, and for material changes we will make reasonable efforts to notify organisation admins directly.
